Zolkrum Construction

Post by Rollie »

So earlier this month I received an email from Zolkrum Construction (http://www.zolkrumconstruction.com/) saying that I was infringing on their copyright. Their claim was the character name Zolkrum, as seen here : http://www.warcraftrealms.com/char/55820842 was somehow infringing upon their rights.

Now, I replied to them that A) this was not a copyright issue, and B) they should contact Blizzard about the character's name, but I guess they were still gunning for me.

Today I received a certified letter from our friends at Zolkrum Construction! I have scanned the pages here for your perusal:

http://www.warcraftrealms.com/images/zo ... krum-1.jpg
http://www.warcraftrealms.com/images/zo ... krum-2.jpg

Again, you can see they are claiming copyright. Methinks they still don't understand what copyright means. Here, I'll give an example.
Ode To Zolkrum
There once as a company from Albuquerque
Whose website was quite an atrocity
They were very sad
And somewhat mad
When their company name showed up on WarcraftRealmsity

Copyright Cooper Sellers 2007
This poem may not be copied or used in part or in whole without previous written consent of the original author.
Granted, I'm no poet, but that is now copyrighted! And if I see it reproduced anywhere, well... well, I'm gonna stomp my feet and pout!

Anyway.... yes I may be fueling the fire here a little. And unfortunately for Zolkrum, anytime someone google's Zolkrum, this post will likely show up now too, but honestly guys, was it really worth all that effort?

Oh, and if you hire a web developer that knows anything about SEO, you can probably get your site to show up above WCR when they search for Zolkrum. If you need a good web dev (and trust me, you do), I'm available for contract work! You know the email =)

Lol! I loved the jab at the end, "I am furious about this blatant disregard for federal law". That's a such a freaking boilerplate letter.

And dugg, just for you.

This is what copyright portects:

Quote: from http://www.gocopyright.com/guide.htm#4
What does Copyright not protect?

Generally, works that have not been fixed in a tangible form of expression are not eligible for federal copyright protection. Copyright does not protect facts, ideas, titles, names, short phrases, slogans, procedures, methods, concepts, principles, and discoveries, although it may protect the way these things are expressed.
I have NO idea how they can make up a word and say I own it. In fact it states a word is NOT protected. The icon they use can be protected since it is artwork however. As you did not steal or copy that no issues.

I wanted to add the word to the wikidictionary that recently came online, but I didn't know what definition to use. Anyone have ideas?

Hmm, I think whoever Zolkrum's attorney on call is talked Mr. Lowry into all this just to boost the attorney fees...

Good times. Seriously, if someone were to actually be searching for Zolkrum Construction to contract them or whatever, I doubt they'd be fooled by this site. I mean seriously, can you see a post looking for construction prices in general discussion here?
